New Rules on 90-Day Waiting Period

The Departments of Labor, Treasury, and Health and Human Services (the Departments) have released the publication of the final regulation implementing a 90-day limit on waiting periods for health coverage.

The final regulation requires that no group health plan or group health insurance issuer impose a waiting period that exceeds 90 days after an employee is otherwise eligible for coverage. The rule does not require coverage to be offered to any particular individual or class of individuals. The rule applies to grandfathered and non-grandfather group health plans and health insurance issuers. Click here for a copy of the final regulation.
